Baku AI — Terms of Service

These Terms of Service ("Terms") govern your use of the Baku AI mobile application ("the app"). By downloading or using Baku AI, you agree to these Terms. If you do not agree, please delete the app.

1. About the app

Baku AI is an offline bedtime-story companion designed for children ages 3–7 and their parents. It generates gentle, age-appropriate stories on your device using a small language model, plays preset illustrated stories, and offers lullabies, guided meditation, and ambient sounds to help children fall asleep.

The app is developed and maintained by Jingyang Ye, an independent developer based in California, referred to below as "we," "us," or "the Baku AI team."

2. Who can use Baku AI

  • Anyone may download and use the app
  • The app is designed for children ages 3–7, used together with or under the supervision of a parent or guardian
  • Parents are responsible for supervising their children's use of the app and for configuring iOS Screen Time or Content Restrictions if desired
  • Users under 13 in the United States, and under 16 in the European Economic Area and United Kingdom, should use Baku AI only with parental awareness. Because the app collects no personal data (see our Privacy Policy), no verifiable parental consent is required under COPPA or GDPR-K

3. License grant

Subject to these Terms, we grant you a personal, limited, non-exclusive, non-transferable, revocable license to install and use one copy of Baku AI on Apple devices you own or control, for personal, non-commercial use.

You may not:

  • Reverse engineer, decompile, or disassemble the app except to the extent local law expressly permits
  • Remove any copyright, trademark, or attribution notices
  • Redistribute, sell, lease, or sublicense the app
  • Use the app to generate content for commercial publication, broadcast, or public performance
  • Use the app in a way that violates applicable law, infringes another's rights, or harms a child

4. AI-generated stories

Baku AI uses a small on-device language model to generate bedtime stories in response to your prompts. You acknowledge and accept the following:

  • AI-generated stories are created by software, not by human authors
  • The model has been configured with strict content guardrails designed to avoid violence, horror, tragedy, or scary content, but no automated filter is perfect
  • If you encounter any story content that feels inappropriate for your child, please stop playback immediately, email us at Metaphoria1688@gmail.com with a description of the issue, and we will investigate and improve the guardrails
  • The app provides no warranty that every generated story will be medically, psychologically, or developmentally appropriate for every child. Parents know their children best; please exercise judgment

5. In-app purchases and subscriptions

Baku AI offers optional paid upgrades:

  • Baku Basic (one-time purchase): unlocks unlimited AI story generation and additional preset stories
  • Story Master (monthly subscription): unlocks all Basic features plus premium voices and additional story packs

How purchases work

  • All payments are processed by Apple via the App Store
  • Prices are shown in your local currency before confirmation
  • For Kids Category compliance (App Store Guideline 1.3), every purchase button is gated behind a parental verification challenge. Children cannot purchase by accident
  • Purchases are linked to your Apple ID, not to any account with us
  • Family Sharing: one-time purchases may be shared with your Apple Family group, subject to Apple's rules

Subscriptions

  • Monthly subscriptions auto-renew at the end of each period unless canceled at least 24 hours before the end of the current period
  • Manage or cancel subscriptions in iOS Settings → Your Name → Subscriptions
  • No refunds for partial months

Refunds

  • All refund requests are handled by Apple per Apple's standard refund policy: https://reportaproblem.apple.com
  • We do not process refunds directly because we do not process payments

6. Offline operation and the model download

Baku AI is designed to run entirely offline after a one-time AI model download (~1.5 GB) from Hugging Face. You acknowledge:

  • The initial download requires an internet connection and sufficient free storage space
  • The app may fall back to preset stories if the device is low on memory or temporarily unable to run the AI model
  • We do not guarantee uninterrupted model download from Hugging Face; if their service is unavailable, the download may need to be retried later

7. Disclaimer of warranties

Baku AI is provided "as is" and "as available," without warranty of any kind, express or implied, including but not limited to warranties of merchantability, fitness for a particular purpose, and non-infringement.

We do not warrant that:

  • The app will meet your specific requirements
  • The app will be uninterrupted, timely, secure, or error-free
  • Any particular story content will be generated
  • The app will help your child fall asleep (though we genuinely hope it does)

8. Limitation of liability

To the maximum extent permitted by law, the Baku AI team is not liable for any indirect, incidental, special, consequential, or punitive damages arising from your use of or inability to use the app, including but not limited to loss of sleep, loss of data, or emotional distress.

Our total liability to you for any claim arising from these Terms or your use of the app is limited to the amount you paid for the app in the 12 months preceding the claim, or USD $20, whichever is greater.

Some jurisdictions do not allow the exclusion or limitation of liability for consequential or incidental damages, so this limitation may not apply to you in full.

9. Intellectual property

  • All code, designs, illustrations, sound recordings, and preset story text are owned by us or our licensors
  • The on-device AI model is Google's Gemma 4, used under its respective open-source license
  • Stories YOU generate with the app belong to you — we do not claim any rights to content you create using the app
  • Trademarks "Baku AI" and the Baku logo are ours; please do not use them without written permission

10. Termination

You may stop using the app at any time by deleting it from your device. We may suspend or terminate your license if you materially violate these Terms. Sections 7 through 12 survive termination.

11. Changes to these Terms

We may update these Terms from time to time. If we make material changes, we will:

  • Update the "Last updated" date at the top
  • Describe the change in the app's release notes
  • For changes that expand our rights or reduce yours, give you at least 30 days' notice in-app before the change takes effect

Continuing to use the app after changes take effect constitutes acceptance of the revised Terms.

12. Governing law

These Terms are governed by the laws of the State of California, United States of America, without regard to conflict of law principles. Any dispute arising from these Terms or the app will be resolved in the courts of that jurisdiction, unless your local consumer-protection law grants you a non-waivable right to sue in your own jurisdiction, in which case that right is preserved.
